Event Safety, Assumption of Risk and Release of Liability
Romanian Food Festival DFW · Saint Mary’s Romanian Orthodox Church · 3801 Glade Road, Colleyville, Texas
Please read carefully. By entering the festival grounds, the parking areas or the shuttle, you agree to the terms below for yourself and for any minor in your care. If you do not agree, please do not attend.
In this notice, “the Festival” means the Romanian Food Festival DFW and every activity connected to it, on the church grounds, in the parking areas and on the shuttle. “Festival Parties” means Saint Mary’s Romanian Orthodox Church, the Romanian Food Festival DFW, their clergy, board members, employees, volunteers, sponsors and organizers, and the vendors, performers and contractors working at the Festival.
1. You attend at your own risk
The Festival is a crowded outdoor public event. Attending involves risks that cannot be fully eliminated, including injury, illness, death and loss of or damage to property. You attend voluntarily and accept all of these risks, known and unknown, including those described below.
2. Children must be supervised at all times
Minors must be accompanied and actively supervised by a parent, guardian or responsible adult at all times, everywhere at the Festival. Parents and guardians are solely responsible for the safety and behavior of their children. This includes fireworks, shows, performances, dancing, games and children’s activities, and the areas near grills, cooking areas, tents, the stage, sound and lighting equipment, vehicles and the bar. Children may not be left unattended. Festival volunteers do not provide childcare. If a child is lost, tell the nearest volunteer immediately.
3. Fireworks, sparklers and special effects
The Festival may include fireworks, pyrotechnics, sparklers, smoke machines, lights and other special effects. These can cause burns, eye and hearing injuries, sparks, falling debris, smoke and sudden loud noise. Watch only from the designated viewing areas, stay behind barriers and at the distances indicated, and follow all instructions from staff. Never approach or touch fireworks, launch areas or debris, even after the show. Guests may not bring, light or use their own fireworks of any kind.
If sparklers are handed out, you use them at your own risk. Hold them away from your face, body, clothing and other people, never point them at anyone, and put them in the containers provided once they burn out. Children may hold sparklers only under the direct supervision of an adult. Smoke and noise can affect young children, pets and people with asthma, breathing or heart conditions, noise sensitivity or PTSD, who should take precautions or keep their distance.
4. Grills, open flames, hot coals and cooking areas
Food is cooked on site on grills, open flames, hot coals, fryers and hot surfaces. Hot food, oil and drinks are served. Heat, smoke and sparks are present near cooking areas. Keep a safe distance, keep children away, and never touch grills, coals, equipment or containers. Areas marked “Volunteers Only” are closed to the public.
5. Food and allergies
Food is prepared in shared facilities and may contain or come into contact with allergens, including milk, eggs, wheat (gluten), soy, peanuts, tree nuts, fish, shellfish and sesame. No item can be guaranteed allergen-free. If you have a food allergy or dietary restriction, ask before ordering. You eat and drink at your own risk.
6. Alcohol
Alcohol is served only to guests 21 and older with a valid ID, and only in the designated areas. Servers may refuse service to anyone. Drink responsibly: you are responsible for your own conduct and for getting home safely. Never drink and drive. Minors may not buy, hold or drink alcohol.
7. Crowds, grounds, tents and structures
Expect crowds, lines and people moving in every direction. Also expect uneven or wet ground, holes, gravel, curbs, steps, cables, cords, ropes, stakes, tent poles, barriers, equipment, and vehicles or carts moving on or near the grounds. Tents, canopies, booths, signs and decorations are temporary and can move, shift or fall, especially in wind or rain. Watch your step, stay clear of tent lines and poles, and do not climb on or lean against structures, the stage or equipment. You are responsible for your own movements and for avoiding collisions with other people.
8. Music, stage, dancing and activities
Amplified music can be loud, and hearing protection is recommended, especially for children. Taking part in dancing (including the hora), games, contests, children’s activities, play equipment or any other activity is voluntary and at your own risk. Do not go on the stage or near sound and lighting equipment unless the organizers invite you.
9. Weather and outdoor conditions
Conditions may include heat, sun, cold, rain, wind, storms, lightning, insects and low light after dark. Dress appropriately and stay hydrated. The Festival may change, delay, pause or cancel any part of the program, including the fireworks, at any time, for safety or any other reason.
10. Health and emergencies
You are responsible for your own health. If you have a medical condition, take the precautions you need, and do not attend if you are sick. Public events carry a risk of exposure to contagious illnesses. Festival volunteers are not medical professionals. In an emergency, call 911, notify the nearest volunteer, and follow the instructions of staff and first responders.
11. Parking and shuttle
You use the parking areas and the shuttle at your own risk. The Festival Parties are not responsible for vehicles or their contents, or for theft, damage, towing or accidents in parking areas. On the shuttle, follow the driver’s instructions, stay seated and keep children with you. Shuttle times may change.
12. Personal property
The Festival Parties are not responsible for lost, stolen or damaged personal belongings.
13. Rules and conduct
Follow posted signs and the instructions of staff, volunteers, security and law enforcement. The Festival may refuse entry to, or remove, anyone whose behavior is unsafe, disruptive or unlawful, without a refund. The following are not allowed:
- personal fireworks
- weapons where prohibited by law or by posted signs
- illegal drugs
- outside alcohol
- unauthorized drones
- fighting
- any behavior that endangers others
14. Photos and video
The Festival may photograph, film and record the event, including attendees. It may use these images and recordings without compensation on its website, social media and promotional materials. By attending, you consent to this for yourself and for any minor in your care.
15. Vendors, performers and third parties
Independent vendors, performers, contractors and other third parties are responsible for their own products, services and conduct.
16. Release of liability
To the fullest extent permitted by law, by attending the Festival you assume all risks, on behalf of yourself, your heirs and any minor in your care. You also release, waive and discharge the Festival Parties from any and all claims, demands and liability for injury, illness, death, or loss of or damage to property arising out of or related to your attendance at or participation in the Festival, including claims arising from the negligence of the Festival Parties. This release does not apply to gross negligence, intentional misconduct or any liability that cannot be waived under Texas law.
17. Your responsibility
You agree to be responsible for, and to reimburse the Festival Parties for, any loss, damage or claim caused by your actions or by the actions of any minor in your care.
